Athinex – Terms of Service

These Terms of Service ("Terms") govern access to and use of the Athinex cybersecurity platform and services provided by Athinex L.L.C. ("Athinex", "we", "our", or "us").

By accessing or using the Athinex platform, the customer ("Customer", "you") agrees to be bound by these Terms.

If you are using the platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.


1. Overview of Services

Athinex provides cybersecurity exposure intelligence and attack surface management services designed to help organizations identify, monitor, and manage exposed digital assets.

Services may include but are not limited to:

  • Attack Surface Management (ASM)
  • Exposure Discovery and Asset Monitoring
  • Vulnerability Identification
  • Risk Scoring and Security Intelligence
  • Security Findings Management
  • Integration with external security platforms

The platform may perform both passive and active security discovery techniques.

These techniques may include but are not limited to:

  • DNS analysis
  • Certificate transparency monitoring
  • Service discovery
  • Port scanning
  • Service fingerprinting
  • Vulnerability detection techniques

Services may be delivered through:

  • Software-as-a-Service (SaaS)
  • Hybrid deployments
  • On-premise deployments

Athinex services are intended exclusively for legitimate defensive cybersecurity operations.


2. Authorization to Monitor and Scan Assets

The Customer represents and warrants that it owns or has explicit authorization to assess and monitor all assets submitted to the Athinex platform.

Assets may include but are not limited to:

  • Domains
  • Subdomains
  • IP addresses
  • Web applications
  • APIs
  • Cloud services
  • Network infrastructure

Customers must ensure that all monitoring and scanning activities conducted through Athinex comply with applicable laws and internal policies.

Athinex shall not be responsible for unauthorized testing performed by customers against third-party systems.


3. Acceptable Use

Customers agree not to use the Athinex platform to:

  • Perform unauthorized security testing
  • Conduct cyber attacks or offensive activities
  • Target assets without authorization
  • Interfere with the operation of the Athinex platform
  • Circumvent platform security controls
  • Reverse engineer platform technology

Athinex reserves the right to suspend or terminate accounts involved in misuse or illegal activities.


4. Customer Responsibilities

Customers are responsible for:

  • Maintaining the confidentiality of account credentials
  • Managing access permissions for internal users
  • Verifying security findings before taking remediation actions
  • Ensuring submitted assets are authorized for monitoring

Customers must promptly notify Athinex of any suspected:

  • Unauthorized account access
  • Credential compromise
  • Misuse of the platform

5. Data Ownership

Customers retain ownership of all assets and data submitted to the Athinex platform.

Athinex stores and processes customer data solely for the purpose of providing platform functionality including:

  • exposure discovery
  • risk analysis
  • vulnerability monitoring
  • reporting and analytics

Athinex does not sell customer data.

Aggregated and anonymized telemetry may be used to improve platform capabilities and threat intelligence.


6. Artificial Intelligence Features

Athinex may provide automated recommendations and analysis generated using artificial intelligence or machine learning technologies.

Certain features may utilize third-party AI providers to generate remediation suggestions or security insights.

These recommendations are provided for informational purposes only and should not be considered authoritative security advice.

Customers are responsible for validating and implementing any recommended actions.


7. Platform Availability

Athinex strives to maintain high service availability.

However, uninterrupted service cannot be guaranteed due to:

  • system maintenance
  • infrastructure updates
  • third-party service dependencies
  • network disruptions

Scheduled maintenance may occur periodically.


8. Third-Party Integrations

Athinex may integrate with external systems including:

  • SIEM platforms
  • log management systems
  • ticketing platforms
  • external security tools

Athinex is not responsible for the availability, reliability, or security of third-party systems.


9. Intellectual Property

All Athinex technology including software, algorithms, dashboards, analytics, and detection mechanisms remain the exclusive intellectual property of Athinex.

Customers are granted a limited, non-exclusive, non-transferable license to use the platform for internal security operations.


10. Limitation of Liability

Athinex provides cybersecurity intelligence and monitoring capabilities but does not guarantee the prevention of security incidents.

To the maximum extent permitted by law, Athinex shall not be liable for:

  • security breaches
  • data loss
  • business interruption
  • indirect or consequential damages

Use of the platform is part of a broader security program.


11. Suspension and Termination

Athinex may suspend or terminate access if:

  • these Terms are violated
  • unauthorized scanning is detected
  • platform abuse occurs
  • legal or regulatory risks are identified

12. Governing Law

These Terms shall be governed by the laws of the United Arab Emirates.
